GENERAL TERMS OF SALE
1.1 The seller is COMPANER OÜ (registry code 12002582, VAT no. EE101400402, legal address: Peterburi tee 2, 11415 Tallinn, Estonia, phone: +372 509 0008, email: info@billiardshop.eu), the operator of the online store billiardshop.eu (hereinafter the “Seller”).
1.1.1 Predator Showroom (Billiardshop.eu) is located on the third floor of T1 Center in Tallinn. All Predator products, including billiard tables, cues, bags, gloves and other accessories, may be viewed on site. If interested, an appointment should be booked in advance by calling +372 509 0008.
1.2 A buyer in the online store billiardshop.eu may be a natural person at least 18 years of age or a legal entity (hereinafter the “Buyer”), who, before completing a sales transaction and when using other services of billiardshop.eu, confirms that they have read these Terms, agree to them, and undertake to comply with them.
1.3 If the Buyer is a natural person under 18 years of age, by completing the sales transaction the Buyer confirms that the transaction entered into with the Seller has been approved in advance by the Buyer’s legal representative in accordance with the law, or that the Buyer performs the transaction using funds provided for that purpose or for free use by the legal representative or, with the latter’s consent, by a third party.
1.4 A Buyer who does not agree to these Terms cannot complete a sales transaction with the Seller.
1.5 Personal data submitted by the Buyer to the Seller shall be processed in accordance with applicable data protection legislation. Data shall be disclosed to third parties only with the Buyer’s consent or in cases prescribed by law.
1.6 The Buyer is responsible for ensuring that their login details (email address and password) do not come into the possession of third parties. The Seller shall not be liable in any way for consequences caused by the Buyer’s login details coming into the possession of third parties through the fault of the Buyer.
1.7 The Buyer is responsible for the accuracy of the data submitted by them. The Seller shall not be liable in any way for consequences caused by inaccurate data entered by the Buyer.
1.8 If the data in the Buyer’s account or registration information changes, such data must be updated on the billiardshop.eu website without delay. The Seller shall not be liable in any way for consequences caused by incorrect or outdated data entered by the Buyer.
1.9 If the Buyer attempts, by action or omission, to undermine, violate, interfere with or disturb the operation of the billiardshop.eu online store, the Seller has the right to restrict or terminate the Buyer’s access to the website immediately and without prior notice, and to refuse to provide services to the Buyer in the future.
PRICES AND PRODUCT INFORMATION
2.1 All prices displayed on the billiardshop.eu website include value added tax.
2.2 The availability and prices of products on billiardshop.eu may change. Such changes take effect from the moment they are published on the billiardshop.eu website. The Seller has the right to change the prices displayed in the online store at any time without prior notice. If prices are changed after the Buyer has placed and paid for an order, the Seller undertakes to supply the products at the prices valid at the moment the order was placed. If the changed price is lower than the price valid at the time the sales contract was concluded, the Buyer shall not be entitled to demand compensation for the difference or to demand that the product be sold at the lower price introduced after the contract was concluded.
2.3 In addition to the purchase price of the product, the Buyer is obliged to pay the transport costs and, where applicable, any carrying service costs related to delivery of the product to the destination entered by the Buyer.
2.4 If, due to a system error, the price of a product has become unreasonably low, billiardshop.eu is not obliged to sell the product at that price and the amount paid shall be refunded to the Buyer.
2.5 If, after the Buyer has placed an order, it becomes apparent that the ordered product is not in stock, the Seller shall notify the Buyer thereof. The Seller’s representative may offer the Buyer the possibility to choose an equivalent product. If the Buyer does not wish to accept a replacement product, the order shall be cancelled and, if payment has already been made, the Seller shall refund the money to the Buyer’s account within a reasonable period of time to the account from which the payment was received.
2.6 The information about products offered for sale is accurate to the best of the Seller’s knowledge. Product images are illustrative and may differ to some extent from the actual appearance of the product.
PLACING AN ORDER AND PAYMENT
3.1 Add the desired products to the shopping cart.
3.2 Before placing the order, the Buyer may add, change or remove products from the shopping cart.
3.3 Fill in the “Customer Details” section. The Buyer is responsible for the accuracy of the submitted information.
3.4 Select the preferred delivery method and, where applicable, the delivery time window. For larger products, carrying service may also be available for an additional fee. Depending on the selected delivery method, the shopping cart may request additional information to specify the delivery destination.
3.5 After selecting the delivery method and entering the address, choose a suitable payment method and click the relevant confirmation button to proceed with the payment.
3.6 Payments in the online store are processed via Montonio. The available payment methods are displayed at checkout and may include bank link payments, card payments, pay later solutions, or other payment options made available by Montonio from time to time.
3.7 The Buyer shall pay for the order according to the payment option selected at checkout and under the terms applicable to that payment method.
3.8 The contract of sale is deemed concluded once the total amount payable for the order has been successfully received by the Seller or confirmation of successful payment has been received through Montonio.
3.9 If the Buyer chooses a bank transfer or any other delayed payment option, and the amount due is not received in full within 3 calendar days from confirmation of the order, the Seller has the right to withdraw from the sales transaction and cancel the order.
3.10 Submission of an order does not automatically reserve the goods. After a successful order, an order confirmation will be sent to the e-mail address provided by the Buyer.
DELIVERY OF THE PRODUCT
4.1 The Buyer is responsible for the correctness of the contact details and delivery information submitted when placing the order. The Buyer is therefore requested always to enter the correct delivery address, phone number and postal code.
4.2 The Seller shall not be liable for delays in delivery or misunderstandings arising if such delays or misunderstandings are caused by inaccuracies or incorrectness in the data submitted by the Buyer when placing the order. If the Buyer has entered the destination or recipient details incorrectly, the Buyer must notify the Seller immediately.
4.3 If the ordered product is not available in stock at the time of order, it will be placed on backorder and delivered within 14 (fourteen) days from the date the order is received and confirmed. If the delivery period is expected to exceed this timeframe, the Seller shall notify the Buyer accordingly.
4.4 If delivery is significantly delayed beyond the timeframe notified by the Seller, the Buyer has the right to cancel the order and receive a full refund of the amount paid. The refund shall be made to the Buyer no later than 14 (fourteen) days from the date of cancellation.
LIABILITIES, OBLIGATIONS AND RIGHTS
5.1 In the event of inaccurate or incorrect recipient and/or delivery information, the Seller has the right to demand compensation for the repeated delivery of the product.
5.2 In addition to the purchase price of the product, the Buyer is obliged to pay the transport costs related to delivery of the product to the destination entered by the Buyer.
5.3 The Seller shall be liable to the Buyer, and the Buyer shall be liable to the Seller, for damage caused to the other party by breach of these Terms in the cases and to the extent provided for in the legislation in force in the Republic of Estonia.
5.4 The Buyer is responsible for the accuracy of the data entered during registration.
5.5 During registration (before the Seller accepts the order), the Buyer must enter their contact details by completing the form with personal data (first name, last name, delivery destination of the product: city, address, postal code, phone number and email address).
5.6 If the aforementioned data is not entered or is entered incorrectly, the Buyer’s ability to use the billiardshop.eu website may be restricted.
5.7 The Seller has the right to:
5.7.1 amend the terms and conditions of the online store at any time and unilaterally, by notifying users through the billiardshop.eu website. New or amended terms enter into force upon publication on the billiardshop.eu website;
5.7.2 change products, product descriptions and product prices;
5.7.3 reimburse the Buyer for product delivery costs in the event of withdrawal from an order or exchange of a product. Only the direct costs of returning the delivered product may remain at the Buyer’s expense, provided that billiardshop.eu informed the Buyer of this before the contract was concluded.
RIGHT OF WITHDRAWAL AND RETURNS
6.1 Pursuant to the Law of Obligations Act, the Buyer has the right to withdraw from a contract concluded by means of distance communication within 14 days and return the purchased product by sending a notice of withdrawal or another unambiguous statement of withdrawal to info@billiardshop.eu. All products may be returned except goods in sealed packaging that are unsuitable for return once opened for hygiene or health protection reasons.
6.2 Upon withdrawal from the contract, the Buyer must return the purchased goods to billiardshop.eu immediately, but no later than within 30 days after notifying the Seller of withdrawal from the contract.
6.3 Requirements for returning a product:
6.3.1 The Buyer may withdraw from the product purchase concluded by means of distance communication within 14 days from receipt of the product. In the event of deterioration of the returned product, the consumer is responsible only if the product has been used in a manner other than what is necessary to ascertain the nature, characteristics and functioning of the product. To ascertain the nature, characteristics and functioning of the product, it should only be handled and used in the manner that would be allowed in a regular physical store. The consumer shall not be liable for any decrease in the value of the goods if billiardshop.eu has not informed the consumer of the existence of the right of withdrawal, including the conditions, deadline and procedure for exercising that right, and, where applicable, the model withdrawal form.
6.3.2 When returning a product, the purchase document and, where applicable, the warranty receipt must be presented.
6.3.3 In the case of returning a computer or phone, no information or data of the consumer, software or personal settings of the consumer may remain stored on the device.
6.3.4 Returned products must be returned to the warehouse address of billiardshop.eu: COMPANER OÜ, Peterburi tee 2, 11415 Tallinn, Estonia.
6.4 To exercise the right of withdrawal, the consumer must submit a corresponding notice of withdrawal or other unambiguous statement of withdrawal to the billiardshop.eu online store at info@billiardshop.eu no later than within 14 days after delivery of the product. A form may be sent by email. The statement must include detailed order information: order number, date, product, price, date of delivery, and the Buyer’s bank account number to which the refund is to be made.
6.5 Upon receipt of the notice of withdrawal, billiardshop.eu shall refund to the consumer without delay, but no later than within 14 days, all payments received from the consumer under the contract, except for the delivery costs borne by the consumer. billiardshop.eu is obliged to refund the consumer within 14 days from receipt of the notice of withdrawal.
6.6 If the reason for the return is a defective product, billiardshop.eu undertakes, at its own expense, to replace the defective product with a compliant product or to refund the amount paid for the defective product.
6.7 If a manufacturer’s defect appears during the use of the product, the consumer has the right to contact an authorized service representative designated by the manufacturer for warranty repair or to require mediation from COMPANER OÜ during the first two years from the date of purchase.
RIGHT TO SUBMIT CLAIMS REGARDING NON-CONFORMITY
7.1 The period for submitting claims is 24 months from the transfer of the product for private individuals. In the case of legal entities, the manufacturer’s warranty period shall apply.
7.2 During the claim period, the consumer has the right to free repair or replacement of the product and, in the event of a material breach of the sales contract, also to withdraw from the contract. If the defect is attributable to the manufacturer, all material and manufacturing defects, as well as labor and spare parts costs, shall be covered.
7.3 The basis for submitting a claim is a document proving the purchase.
7.4 The right to submit claims does not cover instruction in the use of the product, adjustment, maintenance, cleaning, restoration of commercial appearance, or the elimination of defects caused by failure to comply with the instructions for use.
7.5 The right to submit claims does not extend to damage that has occurred during transport after the product has been handed over to the Buyer.
7.6 billiardshop.eu shall not remedy defects appearing during the claim period free of charge if they are caused by:
7.6.1 normal wear and tear;
7.6.2 improper use or maintenance, including cases where the device has been repaired or serviced by a person not authorized by the manufacturer;
7.6.3 defects that were made known to the Buyer by billiardshop.eu before the purchase of the device;
7.6.4 external factors, including but not limited to lightning, non-compliant voltage and voltage fluctuations, moisture, liquid, mechanical damage or similar circumstances;
7.6.5 the product is not working due to the owner’s fault, improper use, failure to follow the user instructions, careless storage, improper maintenance or overloading of the product.
7.7 In determining liability, billiardshop.eu relies on an expert assessment (diagnostics) carried out by the manufacturer’s authorized representative. If the expert assessment shows that the defects are caused by the factors listed above, but repair of the device is possible, the consumer may order paid repair. A device damaged by liquid/moisture and/or mechanical damage shall thereafter be repairable only on a paid basis.
7.8 If the consumer does not agree with the position of billiardshop.eu, the consumer must prove that:
7.8.1 a defect exists (non-conformity with the contract);
7.8.2 the defect or its cause existed at the moment the device was handed over;
7.8.3 COMPANER OÜ is responsible for the defect.
7.10 If billiardshop.eu has provided a sales guarantee for the device, COMPANER OÜ shall ensure elimination of defects in accordance with the terms of that sales guarantee.
7.11 To exercise the right to submit a claim, the Buyer must contact COMPANER OÜ by email at info@billiardshop.eu and instructions will be provided on how to proceed with the product in question.
7.12 In addition to the rights arising from the right to submit claims, the Buyer shall also have all other rights arising under the legislation of the Republic of Estonia.
OTHER TERMS
8.1 Matters not separately regulated in these Terms shall be governed by the legislation in force in the Republic of Estonia.
8.2 Disputes arising between the Buyer and the Seller in connection with the use of the billiardshop.eu online store and the conclusion or performance of a sales transaction shall be attempted to be resolved by negotiation. If no agreement is reached, the Buyer has the right to turn to the Consumer Disputes Committee for the protection of their rights (address: Endla 10A, 10122 Tallinn, Estonia; email: avaldus@komisjon.ee; phone: +372 620 1707).
The Committee is competent to resolve disputes arising from a contract concluded between a consumer and a trader that the parties have not been able to resolve by agreement. Examination of a complaint by the Committee is free of charge for the parties. A statement can be submitted via the relevant TTJA / Consumer Disputes Committee channel.
